Can your Pennsylvania workers’ comp be refused?

However, workers’ compensation claims, like most legal matters can be complicated. It is not uncommon for an otherwise straightforward claim to fall through the cracks. Here are two common reasons why some workers’ comp claims are declined.

Missing crucial timelines

Your workers’ compensation claim begins the moment you sustain an injury or when your injury or illness is reasonably discovered. Per Pennsylvania laws, you have between 21 days and 120 days to report your injury or illness.  Next, you need to file your claim within three years. You risk losing the benefits you are entitled to if you let these important deadlines run out.

Failure to seek treatment

If you are hurt at work, you need to seek treatment for your injuries. This is the most sensible thing to do. Besides getting the medical care you need to get back on your feet, seeking treatment also ensures that you obtain a medical report that directly links your injuries or illness to the workplace incident in question. Without a clear medical report, both your employer and the insurance provider may argue that your injuries had nothing to do with your job.

On the same token, it is important that you follow through with any treatment plan that is recommended by your doctor. Failure to do so can cause problems.
