Social Security Disability: Your Rights

Filing for Social Security Disability benefits can be extremely discouraging. The Social Security Administration denies the majority of initial applications, refusing benefits to many people who should be entitled to them under the law.

At Pfeiffer Brown DiNicola & Frantz in Pottsville, our attorneys have spent decades supporting the injured and the disabled, helping them get the medical and financial benefits they deserve. We can help you, too. Call 570-391-0199 to discuss your case with an attorney for free.

We do not charge our clients any fees unless we win benefits for them.

Qualifying For Social Security Disability Benefits

The Social Security Disability program has a bad reputation. Some people think of it as a handout, when in fact it is a federal insurance program. The FICA taxes that have been deducted from your paychecks all of your working life are your premiums for Social Security Disability Insurance (SSDI). This is your hard-earned money that you have paid into the system, and if you suffer a disabling injury before retirement the SSA should honor your claim.

In order to qualify for benefits:

  • Just as with any insurance program, you need to have paid your premiums — taxes in this case. If you have not been in the workforce long enough to pay enough into the program, you may be eligible for Supplement Security Income (SSI).
  • You must be deemed disabled and unable to work by the Social Security Administration. This condition must be expected to last at least one year or result in death.

While this seems simple on the surface, it is not easy for deserving Pennsylvanians to obtain the benefits they are entitled to. If your SSDI claim has been denied, do not give up. This is very common, and we have helped many people win benefits on appeal.

If your injury stems from an on-the-job accident or occupational illness, we can also help you obtain workers’ compensation benefits.
